The Site Manager(s) of the Pagosa Farmers Market shall enforce these Rules and Regulations. The Farmers Market Committee will interpret these regulations according to the best interest of the Market.
The Mission of the Pagosa Farmers Market is to provide a venue for local and regional food producers, and select non-food producers to sell their products to benefit our community and the earth.
I. Vendors
a. Local farms and gardens in Pagosa Springs and Archuleta County.
b. Regional farms in the Four Corners area.
c. Brokering at the discretion of the Farmers Market Committee.
II. Merchandise
a. Edible: vegetables, fruits, meat, herbs; including seeds, seedlings and starter plants.
b. Prepared food shall comply with Colorado Health Regulations. (Please see Section V.b below.) Goods prepared in home kitchens will not be sold at the Pagosa Farmer's Market. Foods prepared in commercial kitchens are acceptable.
c. Non-edible shall be limited to:
1. flowers: cultivated and wild;
2. fiber: yarns, roving, batting, raw fleeces, and products made locally from locally raised fiber animals; 3. locally crafted herbal products.
d. The Farmers Market Committee reserves the right to approve additional selections of merchandise.
e. No business doing sales promotion will be accepted.
f. Vendors are asked to post their growing methods.
1. Certified Organic, grown with organic methods, or grown conventionally.
2. Vendors are encouraged to profile their farming practices. Tell people who you are with photos, written accounts, and verbal information.
III. Fees
a. Cost of one 10’ x 10’ space for a Vendor selling products from a backyard family garden or community garden and not selling to a retailer or at another venue is:
1. $50 per season paid in full at the first market of the season OR
2. $5 per market paid each week of participation.
b. Cost of one 10’ x 10’ space for a commercial or brokering vendor who sells at other retail venues, with average gross sales of $200 or more per year is:
1. $100 per season paid in full at the first market of the season OR
2. $10 per market paid each week of participation
c. A one-time fee of $5.00 (five dollars) shall be charge to each vendor operating under the Farmers Market umbrella sales tax and business licenses.
IV. Licenses
a. All Vendors are responsible for the necessary licenses and permits required for their booth.
b. The Pagosa Farmers Market will provide an umbrella Colorado sales tax license and Town of Pagosa Springs Business License for Vendors who do not have an individual license.
1. Vendors operating under the Market umbrella license must report their income and pay sales taxes weekly to the Market.
V. State Regulations
a. Vendors must follow Colorado Regulations governing Farmers Markets and it is their responsibility to be in compliance.
b. Any prepared foods sold at the market must be prepared in compliance with the Colorado Department of Public Health and Environment (CDPHE). Refer to www.cdphe.state.co.us and search “farmers markets”.
c. Food Vendors are responsible for the appropriate inspections by CDPHE and must have the appropriate certification, permits, and licenses.
d. Liability for all such products rests solely with the Vendor producing and selling them.
e. Smoking by Vendors is not permitted at the Market.
VI. Set Up and Parking
a. Vendors may park a vehicle and use tailgate or table for selling as space permits. Trailers must be unhitched and vehicles parked elsewhere.
b. Parking will be assigned at two Pre-season Vendor Meetings or, for those unable to attend either meeting, on Market day, by the Vendor Coordinator.
c. Vendors may erect a canopy or umbrella that is weighted or staked to the ground. (A 10’ x 10’ canopy requires 40 lb. weights at each corner.)
d. Vendors are to arrive and set up between 8:30 and 9:00am. Vendors who are not selling directly out of their vehicle must have their vehicle parked outside of the selling area prior to the 9:00am opening time, to ensure safety of customers and vendors.
VII. Location/Day/Time
a. The Pagosa Farmers Market location is the east end of the parking lot of Pagosa Lumber and Hardware: 2435 Eagle Drive.
b. Markets will be held each Saturday beginning July 10 and continuing through September 25.
c. The Market opens at 9:00 a.m. with an announcement by the Site Manager. The Market closes at 1:00pm. No early departures will be allowed.
VIII. Upkeep
a. Vendors are responsible for the upkeep of the general market area located near or in their booth area.
b. Vendors should supply their own trash receptacle and dispose of accumulated trash.
IX. Consumer Comments
a. Consumer comments should be directed to the Site Manager to be brought before the Committee for discussion.X. Vendor Comments and Concerns a. Suggestions, complaints, and comments that cannot be resolved on Market Day must be presented in writing and given to the Site Manager, signed by the Vendor with their name, address and telephone number.
1. Resolution will be considered at the next scheduled Committee meeting and Vendor will be contacted.
b. Bulletins may be sent by e-mail to Vendors to address any issues that need attention or resolution.
